This website is operated by Mineral, a trading name of EE STORE 1 ("Mineral", "we", "us", "our"). We offer this website and everything available through it, including all information, tools, content and products (the "Services"), on the condition that you accept the terms, conditions, policies and notices set out here.

By visiting our site or buying from us, you agree to be bound by these Terms of Service, together with our Privacy Policy, Refund Policy and Shipping Policy. If you do not agree with them, please do not use the Services.

Any new features or tools we add later are also covered by these Terms. We may update, change or replace any part of these Terms by posting the revised version on this page. It is your responsibility to check for changes. Continuing to use the site after a change is posted means you accept it.

Our store is hosted on Shopify, which provides the ecommerce platform we use to run the Services and process transactions.

1. Who Can Order

By agreeing to these Terms you confirm that you are at least 18 years old, or the age of majority where you live, whichever is greater. If you allow a minor in your care to use this site on a device you own or control, you are responsible for their use of it.

You may not use our products for any unlawful purpose, or break any law in your jurisdiction in the course of using the Services.

2. Your Account and Information

You may be asked for information such as your name, email address, and billing and delivery details. You confirm that everything you give us is accurate, current and complete, and that you are entitled to provide it.

You are responsible for keeping your account credentials secure and for everything that happens under your account. You may not sell, transfer or assign your account to anyone else.

3. Our Products

We work hard to represent our products accurately, but colour and appearance can look different depending on your screen and its settings. We cannot guarantee that what you see on your device matches the product exactly.

Product descriptions, availability and pricing can change at any time without notice. We may discontinue a product, or limit quantities available to any person, region or jurisdiction, at our discretion.

4. No Medical or Dental Advice

Everything on this site is provided for general information only. It is not medical or dental advice, and it is not a substitute for guidance from a qualified healthcare professional.

Our products are intended to support your existing oral care routine. They do not replace brushing, flossing, or regular dental check-ups. If you have a dental or medical condition, are pregnant or nursing, or are taking medication, speak to a qualified professional before changing your routine.

Individual results vary depending on factors specific to you, including your age, diet, health and existing oral condition. We make no guarantee that you will achieve any particular result.

5. Orders

When you place an order you are making an offer to buy. Your order is not accepted until we confirm it, and we may decline any order at our discretion. We must receive and process your payment before an order is accepted.

Please check your order carefully before submitting, as we may not be able to change or cancel it once it has been accepted. If we decline, change or cancel an order, we will try to reach you using the contact details you provided.

Returns and refunds are handled solely under our Refund Policy.

6. Prices and Payment

Prices, discounts and promotions can change without notice. The price you pay is the price shown at the time you order, and it will be confirmed in your order confirmation email. Unless stated otherwise, prices exclude taxes, shipping, handling and any customs or import charges.

By submitting payment details you confirm that you are authorised to use the payment method, that the information is accurate, and that sufficient funds are available. We are not responsible for fees your bank or card issuer may charge. If a charge is reversed, we may seek payment by another method.

We are not responsible for pricing or typographical errors, and we may cancel any order arising from one.

7. Shipping and Delivery

Delivery dates are estimates and are not guaranteed. We are not liable for delays caused by carriers, customs clearance, incorrect delivery details, or anything else outside our reasonable control. Title and risk of loss pass to you once we hand the products to the carrier.

8. Electronic Communications and SMS

You agree that we may contact you electronically, by email to the address on your account or by posting notices on the site, and that this satisfies any legal requirement for written communication.

If you give us your phone number and opt in, you consent to receive transactional and marketing text messages from us. Message frequency varies, and message and data rates may apply. Carriers are not liable for delayed or undelivered messages. You can stop at any time by replying STOP, or contact us for help.

9. Reviews and Submissions

If you send us reviews, comments, ideas or other content, you grant us a perpetual, worldwide, royalty-free licence to use, reproduce, edit, publish and display it in any medium, including commercially.

You confirm that you own the rights to what you submit, that you have disclosed any compensation or incentive you received for it, and that it does not infringe anyone else's rights or contain unlawful, abusive, obscene or malicious material. We are under no obligation to keep submissions confidential, pay for them, or respond to them, and we may remove anything we consider inappropriate.

10. Intellectual Property

The Services, including all trademarks, text, images, graphics, video, audio and their design, selection and arrangement, belong to Mineral, our affiliates or our licensors, and are protected by intellectual property laws.

You may use the Services for your own personal, non-commercial purposes only. You may not reproduce, distribute, modify, republish, download, store or transmit any of our material without our written consent. Our name, logo, product names and designs are our trademarks and may not be used without permission.

11. Prohibited Uses

You may not use the Services: for any unlawful purpose; to break any law or regulation; to infringe anyone's intellectual property; to harass, abuse, defame or harm any person; to transmit false or misleading information; to send spam or unsolicited promotional material; to impersonate anyone; to upload viruses or malicious code; to collect or track other people's personal information; to scrape or extract data by automated means; or to interfere with the security of the site.

We may suspend or terminate your access at any time, without notice, if we believe you have breached these Terms.

12. Third-Party Links and Tools

The Services may link to, or provide access to, websites and tools operated by others. We do not control or monitor these, we provide access to them as is and without warranty, and we are not responsible for their content, accuracy or practices. Using them is at your own risk. Direct any complaints about a third party to that third party.

13. Errors and Omissions

There may occasionally be typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times or availability. We may correct these and update or cancel orders affected by them at any time without prior notice, including after you have placed your order.

14. Disclaimer of Warranties

Information on the Services is provided for general information only. We do not warrant that it is accurate, complete or useful, and any reliance you place on it is at your own risk.

EXCEPT AS EXPRESSLY STATED, THE SERVICES AND ALL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THESE DISCLAIMERS, SO THEY MAY NOT APPLY TO YOU.

15. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MINERAL AND ITS OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA OR REPLACEMENT COSTS, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT BOUGHT THROUGH THEM, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY.

IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR ONE HUNDRED US DOLLARS, WHICHEVER IS GREATER.

Some jurisdictions do not allow these limitations. Where that is the case, our liability will be limited to the minimum permitted by the law that applies to you. Nothing in these Terms removes any consumer protection right you have under the mandatory law of the country where you live.

16. Indemnification

You agree to indemnify and hold harmless Mineral, its affiliates, officers, directors, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable legal fees, arising from your breach of these Terms, your violation of any law or third-party right, or your use of the Services.

17. Force Majeure

We are not liable for any failure or delay in performing under these Terms where it results from events beyond our reasonable control, including acts of God, flood, fire, earthquake, war, civil unrest, terrorism, government action, pandemic, epidemic, strikes or labour disputes, carrier delays, supply shortages, power outages or telecommunications failures.

18. Not for Resale or Export

You confirm that you are buying our products for your own personal or household use, and not for commercial resale or export. You agree to comply with all applicable laws and regulations relating to the products.

19. Termination

We may terminate this agreement or your access to the Services at any time, at our discretion and without notice. You remain liable for any amounts due up to the date of termination.

The following survive termination: Intellectual Property, Reviews and Submissions, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and any other provision that by its nature should survive.

20. Governing Law

These Terms and any dispute arising from them are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict of law principles. You and Mineral agree to submit to the exclusive jurisdiction of the courts of Hong Kong.

If the mandatory consumer law of the country where you live gives you rights that cannot be excluded by contract, those rights are unaffected by this section.

21. General

Severability. If any provision of these Terms is found to be unlawful or unenforceable, it will be severed and the remaining provisions stay in force.

Waiver. If we do not enforce a right or provision, that is not a waiver of it.

Entire agreement. These Terms, together with our order confirmation and the policies referenced here, form the entire agreement between us and replace any earlier agreements or understandings.

Assignment. You may not transfer or assign these Terms or your rights under them without our written consent. We may assign ours without notice.

Headings. Headings are for convenience only and do not affect interpretation.
